Terms of Use — FleoLink

These FleoLink Terms of Use, together with the FleoLink Privacy Policy (the "Terms"), form a legally binding agreement between you and FleoLink governing your use of this website, our services, and the creation and use of your account. By registering an account or clicking to accept these Terms, you agree to be bound by them. If you do not agree to these Terms, you may not use this website or FleoLink's services.

1. To create an account, you must be at least 18 years old unless applicable law requires otherwise. If you accept these Terms on behalf of a company or other legal entity, you represent and warrant that you have authority to bind that company or entity to these Terms.
2. To create an account, you must provide your email address, password, and other required personal data. The Privacy Policy governs our use of your personal data and related information. By creating an account, you agree to provide complete and accurate information and to keep it up to date.
3. If you do not read these Terms, despite having had the opportunity to do so, FleoLink does not assume any resulting risk or responsibility.
4. For your own security, you agree to use a strong password. Passwords are protected using hashing technology. You must ensure that your access credentials are used only by you and are protected against misuse or unauthorized disclosure. Access to your account is personal to you, and you may not sell, transfer, sublicense, or otherwise make your account available to any other person or company. You are solely responsible for all use of your account and must notify FleoLink of any suspected misuse or loss of your credentials.
5. You may terminate this agreement at any time if you no longer wish to use FleoLink's services. After termination, you will no longer have access to your account or to any services provided by FleoLink under that account.
6. FleoLink may terminate this agreement, delete your account, or restrict your access if you breach these Terms, if there is a security threat to the FleoLink website or services, or if your account is being misused.
7. FleoLink retains all intellectual property rights and all other rights, title, and interest in the FleoLink account, platform, and all materials made available through it.
8. You agree that FleoLink's services are licensed, not sold, to you. Under this agreement, you do not acquire any ownership rights in the services or any related materials beyond the limited right to use them in accordance with the license granted.
9. FleoLink's account, services, and materials are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable mandatory law, neither FleoLink, its affiliates, nor its suppliers warrant that the materials or services will be uninterrupted, error-free, virus-free, accurate, or complete. No warranty of any kind, whether express or implied, including warranties of title, non-infringement, merchantability, or fitness for a particular purpose, is made with respect to the availability, accuracy, reliability, information, or content of FleoLink's materials or services.
10. Your use of your account, and of the services and materials provided by FleoLink, is at your own discretion and sole risk. FleoLink, its affiliates, and its suppliers are not liable for lost profits, lost revenue, loss of data, data recovery costs, or any indirect, special, consequential, incidental, punitive, or similar damages or expenses of any kind. In no event will the total liability of FleoLink, its affiliates, and its suppliers to you, regardless of the legal basis of the claim (including tort, contract, or otherwise), exceed EUR 20. These limitations do not apply to damages resulting from FleoLink's intentional misconduct or deliberate recklessness.
11. Location data, map data, directions, and other features or content included in or accessible through FleoLink's services may be inaccurate, incomplete, or dependent on network availability. You must rely on your own judgment and take real-world conditions into account. You are responsible for your own conduct and must comply with local laws when using our services.
12. As the account holder, you are responsible for clearly and regularly informing the actual user (driver) of the device that their location may be tracked or otherwise identifiable through the service.
13. You agree that FleoLink may send you notices, emails, and messages related to the services. You agree to keep your contact information up to date. You also understand and accept that such notices may be generated automatically.
14. Your access to and use of FleoLink's services depend on timely payment of the applicable fees and on the plan you have chosen. Some services may be provided free of charge; for more information, please check your account. Amounts not paid when due will accrue interest at a rate of 1.5% per month or the maximum rate permitted by law. All fees are non-refundable.
15. These Terms are governed exclusively by the laws of Lithuania, without regard to its conflict of laws rules. Any dispute between you and FleoLink relating to these Terms, FleoLink's services or materials, or the use of your account must be submitted to the courts of Vilnius, Lithuania.
16. If any provision of these Terms is unenforceable, the unenforceable part will be removed and the remaining provisions will remain in full force and effect. You may not assign or transfer your rights or obligations under these Terms without our written consent.
17. FleoLink may assign its rights and obligations to its affiliates, to any company under common control with FleoLink, or to a third party in connection with a merger, acquisition, sale of assets, or by operation of law.
18. We may modify these Terms at any time without prior notice. You are responsible for reviewing the Terms regularly. If you do not agree to the modified Terms, you may not continue using your account.
